designated by the issuing judicial authority, if appropriate, according to the law of the issuing
Member State. The requested person shall be heard according to the Romanian Criminal Proce-
dure Code and under the conditions agreed upon by the judicial authorities involved. In all cases,
the procesual rights of the requested person must be observed.
ARTICLE 93
Procedural incidents
Where, during the procedure of executing a European arrest warrant, the Constitutional Court
is seized with a plea of unconstitutionality regarding any provision included in this Title, the plea
must be tried with priority, within 45 days from the date when the plea was submitted to the
Constitutional Court.”
ARTICLE 94
The judgement
(1) In all cases, the court shall decide upon the execution of the European arrest warrant by
means of a judgement, while observing the time limits in Art. 95. In order to reach this judgement,
the court shall take account of all the circumstances of the case and of the need to execute the
European arrest warrant.
(2) Within 24 hours of the time when the judgement of surrender becomes final, the court
shall communicate it to the issuing judicial authority, to the Ministry of Justice and to the Centre
for International Police Cooperation within the Ministry of the Interior and of Administrative Re-
form.
(3) Where the surrender of the requested person has been postponed, regardless of whether,
at the time that the judgement was rendered, the requested person was under the effects of a
warrant for preventive arrest or under the effects of a warrant for enforcement of imprisonment
issued by Romanian judicial authorities, the arrest warrant in Art. 90 para. (13) shall be enforced at
the date when the grounds that justified the postponement have ceased.”
ARTICLE 941
Means of judicial review
(1) The orders in Art. 90 para. (2), (8) and (9) may be appealed against on points of law within
24 hours from their issuing.
(2) The judgement in Art. 94 para. (1) may be appealed against on points of law within 5 days
of pronouncement, unless the requested person has consented to being surrendered, in which
