PART C Decision on request for extradition
Section 33
(1) After Our Minister has received the documents in accordance with section 32, he shall de-
cide as soon as possible on the request for extradition.
(2) If extradition has been declared inadmissible by final judgment of a court, the request shall
be refused.
(3) If extradition has been declared inadmissible solely on account of the inadequacy of the
documents submitted, Our Minister may defer a decision. The same shall apply if extradition has
been declared admissible, but Our Minister deems further documents necessary to enable him to
take a proper decision.
(4) In the event that Our Minister defers his decision, he shall give the authorities of the requ-
esting state the opportunity to submit additional documents within such reasonable time as he
may specify.
(5) If the additional documents requested are not produced within the time set, Our Minister
shall refuse the request for extradition.
(6) Our Minister’s decision regarding a request for extradition shall be communicated to the
requesting state through diplomatic channels unless some other way has been provided for by
treaty.
Section 34
(1) If Our Minister receives the additional documents within the time set, he may return the
file on the matter to the public prosecutor at the district court which dealt with the request for
extradition. In that event, sections 23 26, 28 32 and 33, subsections 1 and 2, shall once again
apply. If the extradition is declared inadmissible by the Supreme Court on the ground that the do-
cuments are inadequate, Our Minister may forward the file with the additional documents direct
to the Prosecutor General at the Supreme Court.
(2) In so far as the additional documents provide grounds for this, the extradition shall then be
declared admissible by the courts.
Section 35
If two or more states have requested extradition of the same person, Our Minister shall, in de-
ciding on their requests in so far as they are admissible and capable of being granted take into
account the importance of the proper administration of justice and particularly:
