(4) If extradition is declared admissible notwithstanding a submission by the person claimed
in accordance with section 26, subsection 3, then the judgment shall state the findings of the
court with regard to such submission.
Section 29
Articles 37 39, 45 49, 50, paragraph 1, 268, 269, 274, 275, 277, 283, paragraphs 1 and 4, 284
308, 318 322, 324 331, 345, paragraphs 1 and 3, 346, 357 and 362 365 of the Code of Criminal
Procedure shall apply mutatis mutandis. In so far as these provisions relate to a suspect, they shall
apply mutatis mutandis to the person claimed.
Section 30
(1) The judgment of the court shall be served upon a person claimed who was not present
when it was read out. He shall at the same time be informed of any right of appeal open to him
against such judgment and of the time within which such right of appeal may be exercised.
(2) The court shall send Our Minister without delay a certified copy of its judgment. If extradi-
tion has been declared admissible, the copy shall be accompanied by the court’s opinion on the
reply to be given to the request for extradition.
Section 31
(1) Both the public prosecutor and the person claimed may appeal in cassation (Translator’s
note: i.e. on a point of law, not of fact, to the Supreme Court with a request that the decision be
quashed) against the judgment of the district court.
(2) Articles 431 433, 436 440, paragraph 1, 443, 444, 449 paragraph 1, and 450 456 of the Code
of Criminal Procedure shall apply mutatis mutandis.
(3) The registrar of the district court shall informOur Minister without delay of any statements
waiving the right to appeal in cassation or withdrawing such an appeal.
(4) If the court’s decision is quashed in whole or in part, the Supreme Court shall do what the
district court should have done.
(5) The Supreme Court shall send Our Minister a certified copy of its judgment without delay.
Section 32
Immediately the court’s judgment on the request for extradition has become final, the regist-
rar of the court which last dealt with the matter shall return such request to Our Minister together
with the documents pertaining to it.
