The issuing court shall have the warrant translated into the language required by the executing
Member State, after the whereabouts of the requested person are confirmed in the territory of a
certain Member State of the European Union. If there is no licensed translator in the jurisdiction
of the issuing court for the foreign language into which the translation is required, the issuing ju-
dicial authority shall request support from the Ministry of Justice, which shall ensure translation.
(7) To keep records of court activity, a Register shall be created and kept regarding the Euro-
pean arrest warrants. This Register must include the following mentions: the current number; the
name, forename and nationality of the requested person; the number and date of the notice from
the prosecution office or the court with which the criminal proceedings are pending; the number
of the case with the enforcement court; the date of issuing of the European arrest warrant; the
date of transmission of the European arrest warrant; information about the execution of the Eu-
ropean arrest warrant; any reasons why the European arrest warrant was not executed; the date
of surrender of the requested person; any date of withdrawal of the European arrest warrant. This
Register is not meant to be made public.
(8) The procedure set forth in this Article is confidential until the requested person is arrested
in the executing Member State.”
ARTICLE 82
Transmission of the European Arrest Warrant
(1) When the location of the requested person is known, the Romanian issuing judicial autho-
rity may transmit the European arrest warrant directly to the executing judicial authority.
(2) The issuing judicial authority may decide to issue an alert for the requested person in the
Schengen Information System (SIS), through the National Alert Information System. To this end,
Article 95 of the Convention of 19 June 1990 applying the Schengen Agreement of 14 June 1985
on the gradual abolition of checks at common borders, Schengen.
(3) An alert entered into the Schengen Information System is equivalent to a European arrest
warrant if it is accompanied by the information in Annex No. 1. Transitionally, until the Schengen
Information System is able to transmit all the information in Annex No.1, the alert is equivalent to
a European arrest warrant pending the receipt of the original
