Decision No. 2002/584/JHA of 13 June 2002, published in the Official Journal of the European
Communities No. L 190/1 of 18 July 2002.
ARTICLE 78
The competent Romanian authorities
(1) In Romania, the law courts have been designated as issuing judicial authorities.
(2) The executing Romanian judicial authorities are the courts of appeal.
(2-1) The Romanian authorities that are competent to receive European arrest warrants
are the Ministry of Justice and the prosecution offices of the courts of appeal designated under
para. (2) in the jurisdiction of which the requested person has been located. If the whereabouts of
the requested person are unknown, the European arrest warrant shall be sent to the Prosecution
Office of the Court of Appeal in Bucharest
(3) The Romanian Central Authority is the Ministry of Justice. In its capacity as Central Autho-
rity, the Ministry of Justice:
a) receives European arrest warrants issued by judicial authorities of other Member
States of the European Union and sends them to the prosecution office of the court of appeal in
the jurisdiction of which the requested person has been located or to the Prosecution Office of
the Court of Appeal in Bucharest whenever the requested person has not yet been located, or
whenever the issuing judicial authority is unable to send the European arrest warrant directly to
the receiving Romanian judicial authority;
b) sends European arrest warrants issued by Romanian judicial authorities, whenever
the issuing authority is unable to send it directly to the receiving foreign judicial authority or
whenever the executing Member State has designated its Ministry of Justice as the receiving
authority;
c) keeps records of European arrest warrants issued or received by the Romanian judi-
cial authorities, for statistical purposes;
d) fulfils any other competence provided in the law and meant to provide assistance
and support to the Romanian judicial authorities with the issuing and execution of European
arrest warrants.”
ARTICLE 79
Contents and form of the European arrest warrant
(1) A European Arrest Warrant shall contain the following information:
(a) identity and nationality of the requested person;
(b) name, address, telephone and fax numbers and e-mail address of the issuing judi-
