1 and 3 shall be communicated through diplomatic channels to the state making such request,
unless some other way has been provided for by treaty.
(5) In so far as provided for by treaty, the consent referred to in subsections 1 and 3 shall not
be required if the person claimed has had the opportunity for a period of at least thirty days after
the time of his extradition to leave the territory of the state making the request for consent.
(6) As regards Belgium and Luxembourg, exceptions in cases other than those referred to in
the preceding subsection may be provided for by treaty.
CHAPTER III
Extradition procedure
PART A Provisional arrest
Section 13
(1) In so far as this is provided for by treaty, the provisional arrest of an alien in the Netherlands
may be ordered in the cases described in the following subsection at the request of the compe-
tent authority of another state if there is good reason to expect that a request for his extradition
capable of being granted will shortly be made by that state.
(2) Provisional arrest may be ordered when requested:
(a) in connection with a criminal investigation instituted because the alien is suspected
of being guilty of an offence in respect of which a person may be remanded in custody under the
law of the Netherlands;
(b)with a view to giving effect to a custodial sentence or a non punitive order as men-
tioned in section 7(a);
(c)in cases other than provided for in (a) and (b) if the alien has no fixed abode or place
of residence in the Netherlands.
(3) If there is good reason to expect that a request for provisional arrest capable of being
granted will shortly be made by a state named in article 13, paragraph 5, of the Convention in
respect of an alien who has been handed over by the captain of an aircraft after landing in the
Netherlands, pursuant to article 9, paragraph 1, of the Convention on offences and certain other
acts committed on board an aircraft, or who is suspected of committing an act as referred to in
article 11, paragraph 1, of that Convention on board an aircraft in which he has arrived in the
Netherlands, the provisional arrest of the alienmay be ordered as if it had already been requested.
